隐私政策声明

深圳前海联合交易中心有限公司(在本隐私政策声明中,称为“交易中心”或“我们”,视适用情况而定)明白根据《中华人民共和国民法典》、《中华人民共和国网络安全法》、《中华人民共和国个人信息保护法》等法律法规(以下简称“个人信息保护相关法律法规”)其在收集、持有、处理、使用及/或转移个人信息方面的责任。

本隐私政策声明适用于交易中心网站、交易中心系统、交易中心微信公众号。本隐私政策声明如有任何修订,我们会通过交易中心网站或系统等渠道公布。经更新的版本一经公布即告生效并取代当前版本。如果我们对本隐私政策声明作出重大变更(例如业务功能变更、个人信息出境情况变更、使用目的变更),我们将以更为显著的方式(包括但不限于浏览页面特别提示等)通知您。无论我们是否向您发送具体通知,您应不时关注个人信息收集和使用的相关公告、提示信息及协议、规则或其他相关内容的变动。您知悉并确认,如您不同意更新后的内容,应立即停止使用相应服务,并注销相关的用户账号,我们将停止收集您的相关信息。

我们将会根据本隐私政策声明使用我们不时所收集您的个人信息。

我们定期审阅本隐私政策声明,例如,加入具体指示、政策及条款。

交易中心网站、交易中心系统及交易中心微信公众号的用户为已满十八周岁的成年人,但是由于技术限制,在某些情况下,我们无法识别用户的年龄。若您未达到上述年龄要求,请不要使用交易中心网站或系统并输入您的个人信息。

收集信息的范围和方式

- 您主动提供的信息

1. 处理您的申请、订购及登记使用我们的产品/服务、与此相关的账户管理:您(包括当您代表您的公司,以下统称为“您”)通过交易中心网站或系统注册账户时,您需要向我们提供姓名、性别、证件类型、证件号码、地址、手机号、邮箱。
经您授权,我们将在合法渠道使用您的姓名、身份证号,查询您是否列于失信被执行人名单、World-Check名单,如果您不提供上述信息,我们则无法对您的资格、信用进行评估并决定是否提供您所需的服务。

2. 视频面签开户:您可以通过在约定的时间,以双向视频方式面签开户,验证您的身份,拍摄您签署开户文件及邮寄开户资料,经交易中心审核无误后办理开户手续的流程。为此,您需要在您的设备中向我们开启您的摄像头权限、麦克风权限、相册权限、文件访问权限、相机拍照权限、定位权限、蓝牙权限、获取手机状态权限等,并通过您的设备向我们提供您的人脸、声音、指纹、影像、地理位置等信息用于验证您的身份及提供面签服务。

3. 留言和沟通:您在交易中心网站上向我们留言时,我们会收集您向我们发送的姓名、手机号、电子邮件、企业名称(选填)、留言内容。

4. 关注交易中心微信公众号:您关注交易中心微信公众号时,我们会收集您的微信头像和昵称。

5. 履行受监管交易平台的职能:为了履行交易中心作为交易平台的日常职能,我们还可根据适用法律或根据交易中心业务规则收集并处理您的姓名、性别、证件类型、证件号码、地址、手机号、邮箱。

6. 进行研究和统计分析:为了进行数据、财务及商务研究,进行统计分析,从而向您提供更好的服务,我们将使用您的个人信息、设备信息、您浏览的页面和内容、以及其他使用交易中心网站或系统过程中的其他操作。

7. 履行法定义务:我们也可能会根据适用法律或法规或任何对我们有管辖权限的监管机构及/或其代表的要求而收集并处理您的姓名、性别、证件类型、证件号码、地址、手机号、邮箱、工作资格及就业情况记录等相关信息(包括之前的劳动情况、相关职位及日期、重大成果、教育背景、所取得的学位或证书、日期及颁发机构及其他相关奖项或成就)。

8. 直接营销:如您已经给予同意而其后并无撤回,我们也可能会使用您的姓名、邮寄地址、电话号码和电邮地址,用以向您寄送宣传资料,就交易中心的金融和资讯服务进行直接营销活动。

如不希望收到我们的宣传和直接营销资料,或不希望收到某类宣传和直接营销资料,又或不希望通过某种途径收到此类材料,请通过下文“联系我们”所载的通讯渠道联络我们。为确保可以迅速处理您的要求,请提供您的全名、电邮地址、登录名称及所订阅产品及/或服务的详情。

我们如何委托处理、共享、转移您的个人信息

- 向我们的关联公司共享作直接营销

在获取您同意的前提下,我们会将您的姓名、邮寄地址、电话号码和电邮地址提供给香港交易及结算所有限公司或其关联公司(“香港交易所集团”),使其可向您寄送宣传资料,就其金融和资讯服务进行直接营销活动。

- 向第三方共享个人信息的情况

为了实现本隐私政策所述的目的,您的个人信息可能会提供给下列各方:

1. 香港交易所集团(在香港或其他地方)。请点击此处查看香港交易所集团及该等关联公司的列表及更多详细信息

2. 香港交易所集团在香港或其他地方的任何其他成员的行政、电信、电脑、付款、追收欠款、信息处理或其他服务的代理人、承包商或第三方服务提供商;

3. 其他人士(收集信息时会经您单独同意);

5. 根据法律法规规定,或按政府主管部门的强制性要求,可能向政府机构、监管机构和执法部门提供您的信息。

- 为遵守法律与法规而披露您的个人信息。

交易中心及香港交易所集团的其他成员为了遵守适用法律及法规,或遵守法院指令、传票或其他法定程序(无论于中国或其他地方),或遵从政府机关、执法机构或类似机构(无论位于中国或其他地方)提出的要求,又或履行我们作为受监管的交易平台的义务,可保留、处理及/或披露您的个人信息。交易中心及香港交易所集团的其他成员或须披露您的个人信息,以履行与您的协议,或保护我们或我们雇员的权利、财产或安全,又或执行或履行管理职能。

- 公司重组

随着我们持续发展业务,我们可能会重组公司架构或出现控制权易手或业务合并。在这些情况下,在符合法律法规规定的前提下,您的个人信息或会按本隐私政策声明移交继续运营我们业务或类似服务的第三方。此等第三方或在中国以外的地方,就此等收购或重组而使用您个人信息的地点也可能不在中国。

我们如何存储和传输您的个人信息

我们将在中国境内的服务器上存储您的个人信息。我们会在实现处理目的所必需的时间内保存您的个人信息,除非适用法律要求保存更长时间。保存期限届满后,您的个人信息将被删除或匿名化。然而,为了进行全球业务的管理以及提升我们的服务水平,我们会向中国大陆以外的地区传输您的个人信息。我们会依法履行必要的程序,并采取必要措施保障接收方达到适用的法律法规要求的保护标准。

我们如何保护您的个人信息

我们会采取一切实际可行方法确保个人信息的安全,以及避免个人信息在未经授权或意外的情况下被访问、删除或作其他用途。

但是您仍须注意,由于互联网的开放性质,我们无法保证绝对的安全性。我们会不断实施和更新管理、技术及物理安全措施,以确保您的信息免遭未经授权的访问、遗失、破坏或更改。

您作为个人信息主体享有的权利

- 访问、更正、删除个人信息

根据中国相关的法律法规和监管规定,您有权查明我们是否持有您的个人信息、取得该信息的备份、补充、更正任何不准确信息,要求我们通知您其持有信息的种类。

我们将尽一切可能采取适当的技术手段,保证您可以行使上述权利。您可以通过交易中心网站或系统,以书面及邮递形式等渠道(见以下“联系我们”)行使上述权利,但法律法规和本隐私政策声明另有规定的除外。您有责任及时更新您的相关信息。在访问、更新、更正前述信息时,我们可能会要求您进行身份验证,以保障账户安全。

如您无法自行对您已经提供的个人信息进行更正,请通过下文“联系我们”所载的任何一个通讯渠道与我们联系。我们将采取措施为您做出有关更正。

对于您合理的请求,我们原则上不收取费用,但对多次重复、超出合理限度的请求,我们或会因应您访问信息要求而产生的管理及实际成本而收取合理的费用。

- 可携带权

根据中国相关的法律法规和监管规定,您可以要求我们将您的个人信息转移至您指定的符合国家网信部门规定条件的第三方。

- 注销账户及删除个人信息

如果您注销了我们的账户或与我们的关系被取消或终止或根据个人信息保护相关法律法规的规定,您可以通过交易中心网站或系统,或以书面及邮递形式等渠道(见以下“联系我们”)向我们提出删除个人信息的请求。我们会随即在合理情况下尽快删除或终止处理您的个人信息,但也可按合理需要而保留有关信息,合理的需要包括:信息归档;解决实际或潜在的争议;遵守适用法律法规规定,或按政府主管部门的强制性要求;履行与您的任何协议以及执行或履行我们的法定职能、义务及责任等。

- 撤回同意

根据中国相关的法律法规和监管规定,您有权撤回您的同意。您可以通过关闭我们对您设备的访问权限,或通过交易中心网站或系统,或以书面及邮递形式等渠道(见以下“联系我们”)撤回您的同意。撤回同意后,我们将不再收集和处理您的个人信息,但法律法规和本隐私政策声明另有规定的除外。

请您注意,您撤回同意,不会影响此前我们基于您的同意而开展的个人信息的收集和处理。

- 限制或拒绝处理您的个人信息

您有权限制或者拒绝他人对您个人信息进行处理,我们将按照适用法律的规定为您提供限制或拒绝的途径,请根据上述相同方式与我们联络。

- 响应您的请求

您请求行使享有的个人信息主体权利或要求我们对我们个人信息处理活动的规则进行解释说明,可以通过以下“联系我们”提供的联系方式向我们提出请求。我们将尽合理的努力及时满足您的请求,我们将在收到您的请求并完成对您的身份验证后在适用的法律法规要求的时限内(通常不超过15个工作日内)回复您的请求。

例外情形

按照法律法规要求,如涉及以下情形我们将可能无法响应您提出的访问、更正、删除、注销、撤回同意等的请求:

1. 与国家安全、国防安全相关的;

2. 与公共安全、公共卫生、重大公共利益相关的;

3. 与犯罪侦查、起诉、审判和判决执行等相关的;

4. 有充分证据表明您存在主观恶意或滥用权利的;

5. 响应您的请求将导致您或其他个人、组织的合法权益受到严重损害的;

6. 涉及交易中心商业秘密的;及

7. 法律法规规定的其他情形。

我们通过自动化技术获取的您的信息

(1)我们如何使用cookies

您通过交易中心网站或系统访问或使用我们的信息或服务时,应当留意到网站或系统使用cookies。Cookies指储存在您浏览器内的数据文件。您访问交易中心网站或系统时,网站或系统即在您浏览器内自动安装并使用cookies。交易中心网站或系统使用两种cookies:

  • Session Cookies:一种只在您浏览交易中心网站或系统期间留存于浏览器内的短暂性质cookies,用处在取得并储存配置信息及管理网站或系统,包括“携带”信息以随您浏览网站或系统的不同网页,譬如以免您每到一个网页均要重新输入信息。Session cookies也会用来编制关于交易中心使用情况的匿名统计资料。
  • Persistent Cookies:一种留存于浏览器内较长时间的cookies,用以编制关于交易中心网站或系统使用情况的匿名统计资料,或追踪和记录用户的偏好。

交易中心网站或系统所用的cookies不包含个人信息。您可以更改浏览器或网路安全软件中的设置,拒绝接受浏览器内的cookies。不过,这样或会令您不能使用或启动交易中心网站或系统中的某些功能。

(2)为了向您提供我们的产品和服务,我们还可能通过cookies、web beacon或其他方式在您使用交易中心网站或系统时自动收集下列信息:

1. 设备或软件信息,例如您的设备型号、操作系统、所用的版本和设备识别码、网页浏览器或用于访问我们服务的其他程序所提供的配置信息、您的IP地址、接入网络的方式、类型和状态、网络质量数据、操作日志、服务日志。

2. 在使用我们服务时搜索或浏览的信息,例如您使用的网页搜索词语、访问的社交媒体页面url地址,以及您在使用我们服务时浏览或要求提供的其他信息和内容详情。

3. 有关您曾使用的移动应用程序(APP)和其他软件的信息,以及您曾经使用该等移动应用程序和软件的信息。

4. 在使用我们的开户视频面签服务时,我们需要调用您的设备的相关权限,包括:摄像头权限、麦克风权限、相册权限、文件访问权限、相机拍照权限、定位权限、蓝牙权限、获取手机状态权限等,并通过您的设备向我们提供您的人脸声音指纹影像地理位置等信息用于验证您的身份及提供面签服务。

请注意:如您不向我们提供个人信息(或有关您代理人的个人信息)或同意开启相关功能的访问权限,我们可能无法提供您要求的信息、产品或服务。

(3) 第三方代码、插件

为了向您提供更好的服务,我们可能会通过第三方代码或SDK来收集您的个人信息,以帮助我们为您提供更加全面的服务。我们将在过程中尽力控制和保护对您个人信息的收集。关于我们使用的第三方代码的类型,以及该等第三方代码所收集的数据,请见我们相应服务的SDK信息列表:

Privacy Policy

Privacy Policy Statement

Shenzhen Qianhai Mercantile Exchange Co., Ltd. (深圳前海联合交易中心有限公司) (referred to as “QME”, “we”, “our” or “us” in this Privacy Policy Statement, as applicable) understands the responsibilities in relation to the collection, holding, processing, use and/or transfer of personal data under the “Civil Code of the People’s Republic of China”, the “Cybersecurity Law of the People’s Republic of China”, the “Personal Information Protection Law of the People’s Republic of China” and other applicable laws and regulations (together, “Applicable Personal Data Protection Laws and Regulations”).

This Privacy Policy Statement applies to the QME website, QME system and QME WeChat official account. Any amendments to this Privacy Policy Statement will be published via the QME website or system etc. The updated version of the Privacy Policy Statement will take effect and replace the current version once published. If we make any major changes to this Privacy Policy Statement (e.g., changes to business functions, changes to cross-border transfer of personal data, changes to use of personal data), we will notify you in a prominent manner (including but not limited to posting a special notice on our website etc.). Regardless of whether we give you specific notice, you should regularly review our notices in relation to the collection and use of personal data, notification messages and agreements, rules and other related changes to any relevant content. You acknowledge and understand that, if you disagree with the updated content, you must immediately cease using the relevant services and cancel your user account and we will cease the collection of your relevant information.

We will use your personal data collected in accordance with this Privacy Policy Statement from time to time.

We will regularly review this Privacy Policy Statement and, for example, supplement with specific instructions, policies and terms.

Users of the QME website, QME system and QME WeChat official account shall be adults over eighteen (18) years of age. However, due to technical limitations, in certain circumstances, we are unable to verify the age of users. If you do not meet the age requirement set out above, please do not use the QME website or system nor submit any of your personal data.

What personal data do we collect and how do we collect it?

  • Data directly submitted by or collected from you

1. Data collected when processing your application, subscription and registration to use our products / services and related account management: When you (including when you are representing your company, collectively referred to as “you”) register an account through the QME website or systems, you need to provide us with your name, gender, identification document type, identification document number, address, mobile phone number and email address.
Upon your authorisation, we will, through legal means, use your name and identification card number to check if you are on the List of Dishonest Persons Subject to Enforcement and the World-Check list. If you do not provide us with the aforementioned information, we cannot assess your eligibility and credit worthiness to determine whether we may provide you with the relevant services.

2. Video face-to-face account opening. You can, by scheduling a face-to-face video call, open an account, verify your identity, record the signing of account-opening documents, mail account-opening documents, and once QME verifies the above information, undergo the account-opening process. Accordingly, you need to give us permission to access your camera, microphone, photo album, files, photo-taking function, location, Bluetooth, phone status etc., and, through your device, provide us with information related to your facial images, voice, fingerprints, image, and geolocation etc., for us to verify your identity and provide you with the relevant face-to-face account-opening services.

3. Messages and communication. When you leave us a message on the QME website, we will collect your name, mobile phone number, email address, company name (optional), and message content.

4. Following the QME WeChat official account. When you follow the QME WeChat official account, we will collect your WeChat profile photo and user name.

5. Performing the functions of a regulated exchange. To perform our daily functions as a regulated exchange, we may, in accordance with applicable laws or QME’s rules, collect your name, gender, identification document type, identification document number, address, mobile phone number and email address.

6. Conducting research and statistical analysis. To provide you with better services, we will use your personal data, device information, your browsing history, and other actions taken during your use of the QME website or system to conduct data, financial and business research and conduct statistical analysis.

7. Fulfilling our legal obligations. We may also collect and process your name, gender, identification document type, identification document number, address, mobile phone number, email address, work qualifications, employment information and such information related to your employment records (such as previous employment details, relevant positions held and dates, major achievements, educational background, degrees or certificates obtained, date and issuing institutions and any other related awards or achievements) in accordance with applicable laws or regulations or as required by any regulatory authority with jurisdiction over us and/or their representatives.

8. Direct marketing. If you have given us your consent and have not subsequently withdrawn it, we may also use your name, mailing address, phone number and email address to send you promotional materials and conduct direct marketing activities in relation to QME’s financial and information services.

If you do not wish to receive our promotional or direct marketing materials, or you do not wish to receive certain categories of promotional materials or direct marketing materials, or you do not wish to receive such materials through certain channels, please contact us in accordance with the “Contact Us” section below. To ensure that we can promptly process your request, please provide your full name, email address, login name, and details of the products and/or services which you have subscribed to.

How do we process, share or transfer your personal data?

  • Sharing with our affiliates for direct marketing

    Subject to obtaining your consent, we will disclose your name, mailing address, phone number and email address to the Hong Kong Exchanges and Clearing Limited and its affiliated companies (together, “HKEX Group”) so that HKEX Group may deliver to you promotional materials, or conduct direct marketing activities in relation to HKEX’s financial and information services.

  • Sharing personal data with third parties

    In order to fulfil the purposes set out in this Privacy Policy Statement, your personal data may be disclosed to the following third parties:

    1. HKEX Group (in Hong Kong or otherwise). Please click here for a list and further details of HKEX Group and its affiliated companies;

    2. Agents, contractors or third party service providers who provide administrative, telecommunications, IT, payment, debt collection, information processing or other services to any member of HKEX Group in Hong Kong or elsewhere;

    3. Other persons (subject to obtaining your separate consent at the time of data collection);

    4. Subject to obtaining your consent, we may share your personal data (e.g., name, mobile phone number) with third parties related to the provision of our products and services (e.g., banks, warehouses). Please click here for a list and further details of such third parties;

    5. We may disclose your personal data to government agencies, regulatory authorities, and law enforcement agencies in accordance with applicable laws and regulations, or upon the mandatory request of a competent government authority.

    To achieve the above purposes, you consent to the transfer of your personal data outside of Mainland China.

  • Disclosing your personal data for compliance with laws and regulations.

    QME and other members of HKEX Group may keep, process, and/or disclose your personal data for compliance with applicable laws and regulations, or for compliance with court orders, summons or other legal processes (whether in China or otherwise), or for compliance with requests from government agencies, law enforcement agencies or other similar agencies (whether located in China or otherwise), or to fulfill our obligations as a regulated exchange. QME and other members of HKEX Group may need to disclose your personal data to perform our obligations under the agreement(s) with you, or to protect us or our employees’ rights, property or safety, or to carry out or perform our administrative functions.

  • Company Restructuring

    As we continue to develop our business, we may restructure our organisational structure or there may be a change of control or we may merge our business. In these circumstances, and subject to compliance with laws and regulations, your personal data may, in accordance with this Privacy Policy Statement, be transferred to third parties who continue to operate our business or provide similar services. These third parties may be located outside of China, and your personal data may be used outside of China for the purposes of such acquisition or restructuring.

How we store and transfer your personal data

We will store your personal data on servers located in Mainland China. We will retain your personal data for as long as necessary to fulfill the purposes of our processing, unless applicable laws require a longer retention period. Upon expiration of the retention period, your personal data will be deleted or anonymised. However, for the purposes of managing our global business and to improve our services, we will transfer your personal data outside China (for a list and further details of HKEX Group and its affiliated companies, please see the “Sharing personal data with third parties” section above). We will carry out all necessary procedures in accordance with laws and take all necessary measures to ensure that the data recipients meet the protection standards required by applicable laws and regulations.

How we protect your personal data

We will take all practicable measures to ensure the security of personal data, and prevent unauthorised or accidental access, deletion or other use of personal data.

However, you should be aware that, due to the open nature of the Internet, we cannot guarantee absolute security. We will continuously implement and update our management, technical, and physical security measures to ensure that your data is protected from unauthorised access, loss, destruction or alteration.

Rights over personal data

1. Access, correct or delete your personal data

According to relevant laws and regulations and regulatory requirements in the People’s Republic of China, you have the right to ascertain whether we possess your personal data, obtain a copy of such personal data, supplement and rectify any inaccurate personal data, and request us to notify you of the categories of personal data that we possess.

We will take all possible and appropriate technical measures to ensure that you could exercise the above rights. You may exercise your rights through the QME website or system, by mail and in writing etc. (please see “Contact Us” section below), unless otherwise provided by laws and regulations and/or this Privacy Policy Statement. You have the responsibility to update your relevant data in a timely manner. When accessing, updating or rectifying the above information, we may require you to verify your identity to ensure the security of your account.

If you are unable to correct personal data which you have provided to us by yourself, please contact us through any of the means listed in the “Contact Us” section below. We will take measures to make the relevant correction for you.

If your request is reasonable, we will not charge any fees in principle. However, for multiple and unreasonably excessive requests, we may charge a reasonable fee based on the administrative and actual costs of complying with your request to access your personal data.

2. Data portability

According to relevant laws and regulations and regulatory requirements in the People’s Republic of China, you may request us to transfer your personal data to a third party designated by you and who meets the criteria stipulated by the Cyberspace Administration of China.

3. Cancellation of your Account and deletion of personal data

If you deleted your account with us, or your relationship with us has ceased or is terminated, or in accordance with Applicable Personal Data Protection Laws and Regulations, you may, through the QME website or system, or by mail and in writing etc. (see “Contact Us” section below) request us to delete your personal data. We will reasonably and promptly delete or cease our processing of your personal data, but we may also retain relevant data as is reasonably necessary, including: for archival purposes; for use in any actual or potential dispute; for compliance with applicable laws and regulations, or upon the mandatory request of a competent government authority; for our performance of any agreement with you or for performance of our statutory functions, obligations, and responsibilities etc.

4. Withdrawal of consent

According to relevant laws and regulations and regulatory requirements in the People’s Republic of China, you have the right to withdraw your consent. You may withdraw your consent by changing the access permissions to disable our access to your device, or through the QME website or system, or by mail in writing etc. (please see “Contact Us” section below). After withdrawing your consent, we will no longer collect or process your personal data, unless otherwise required by laws and regulations and/or this Privacy Policy Statement.

Please note that your withdrawal of consent will not affect our processing and collection of your personal data based on your consent prior to your withdrawal of consent.

5. Restricting or objecting to our processing of your personal data

You have the right to restrict or object to the processing of your personal data, and we will provide you with a means to do so in accordance with applicable laws. Please contact us in accordance with the methods described above.

6. Our response to your request

If you request to exercise your data subject rights or request us to explain our rules for personal data processing activities, you may make your request in accordance with the contact methods listed in the “Contact Us” section below. We will make all reasonable efforts to fulfil your request in a timely manner. We will, after receiving your request and verifying your identity, respond to your request in the time limit prescribed by applicable laws and regulations (usually no longer than 15 working days).

Exceptional circumstances

In accordance with requirements under laws and regulations, we may not be able to respond to your request to access, rectify or delete your personal data, cancel your account or withdraw your consent if any of the following circumstances apply:

1. it is related to national security or national defence;

2. it is related to public safety, public health, or significant public interest;

1. How we use cookies
